TUATARA TOURS NZ LTD TERMS AND CONDITIONS

CONTRACT
This contract is between Tuatara Tours NZ Ltd (hereinafter called TTNZ) and you the client (in this agreement “client” means any person being any person travelling or intending to travel on a tour supplied by TTNZ.) The contract, including all matters arising from it, is subject to New Zealand law and the exclusive jurisdiction of the New Zealand courts. TTNZ reserves the right to vary or omit any of the terms of this contract at any time.
PRICE
The price is quoted in New Zealand dollars and includes GST of 15% unless stated otherwise
The price quoted at the time you make the booking is based on rates available at that time.  TTNZ reserves the right to vary, without notice, those prices.
If the client makes or intends to make payment of the tour using an American Express card, such payment will incur an additional 2% surcharge on any quoted price.
TOUR ACCOMMODATION
Organised tour accommodations are based on a twin/double share accommodation unless stated otherwise. Individual travellers will be placed in rooms together with other individual travellers of the same gender. A single supplement is available on request for most tours.
CONFIRMATION OF BOOKING
Your booking will only be confirmed on receipt of the full tour price. TTNZ or their agents reserve their right to decline any booking at their discretion.
MEDICAL CONDITIONS
When you book you must notify us of any medical condition, medical history or medication that you are on.
Full disclosure of all your medical conditions, including any medications you are taking or have been prescribed  is required  at the time you make this booking. In the event that you, the client, do not fully disclose to TTNZ any and all medical conditions at the time of booking then TTNZ reserves the right to remove the client from the tour at its sole discretion
WEATHER
Adverse weather conditions may mean that planned activities will not proceed as intended. A decision to change an advertised tour based on the weather conditions will be made by a TTNZ employee at the time and is made in the best interest of the group and their safety. TTNZ and or their contracted suppliers cannot be held responsible to any changes as a result of the weather.
CANCELLATION OF TOURS
If a client wishes to cancel a tour they have booked through Tuatara Tours the following charges will be applied unless stated otherwise on the booking form
1.    Prior to 6 weeks of departure of the tour 10% of the tour cost;
2.    Within 6 to 3 weeks 35% of the tour cost; and
3.    Within 3 weeks or less no refund will be given.
If a client fails to join the tour, or joins after the tour departure date, no refund will be made.
TTNZ reserves the right to cancel any tour prior to departure in the event that Tuatara Tours deems there are too few people booked on a tour to make it a worthwhile experience. In the event your booked tour is cancelled at the discretion of TTNZ, you will be offered a chance to transfer to an alternate TTNZ tour or, if the client does not wish to be transferred to an alternative tour, a full refund of any monies you have paid to TTNZ will be made to the client.
TTNZ strongly recommends that the client take out tour cancellation insurance together with all other necessary travel insurances. Obtaining all necessary insurances is the responsibility of you the client and TTNZ will not held liable for any failure on your part to get insurance. (Please Note: such insurance does not usually cover a change of mind).
If TTNZ cancel your booking on the basis of the information provided within the questionnaire, then you agree to you release and forever abandon any claim you may have against TTNZ as a consequence of the cancellation.
AIRLINES AND OTHER TRANSPORT PROVIDERS
These conditions relate exclusively to an agreement between yourself and TTNZ and we have no obligation or commitment to any airline or similar services whose services you may be using in conjunction with a TTNZ tour.
If TTNZ is prevented (directly or indirectly) from performing any of its obligations under this agreement by reason of act of God, strikes, trade disputes, fire, breakdowns, interruption of transport, government or political action, acts of terrorism, acts or omissions of a third party or any other cause whatsoever outside TTNZ NZ Ltds’ reasonable control, TTNZ will be under no liability to you and may, at its option, by written notice, either cancel the tour and give you a full refund or arrange alternative tour arrangements.
OPERATING PARTNERSHIP
From time to time Tuatara may operate in conjunction with another tour operator who has particular experience in that geographical area, or the type of product being offered. In these situations our same terms and conditions will apply, and your responsibilities and commitments will remain the same.
GENERAL CONDITIONS
TTNZ NZ Ltd, its agents, contractors and employees do not accept responsibility or liability for loss, damage to, or theft of personal belongings (owners risk) or for any expenses, including medical and transport expenses arising from personal accident, injury, illness, or hospitalisation. TTNZ and their employees reserve the right to make any alterations to the itinerary in the interest of safety, comfort or any unforeseen circumstances due to causes such as weather, illness, or misadventure. Every reasonable endeavour will be made to keep to published schedules but no guarantee is given. TTNZ will not be held liable for costs incurred by change, delay or the missing of connecting services. TTNZ reserves the right to exclude a person from a tour at any time, if in the opinion of the TTNZ employee or operator, that person may be likely to risk the health, safety or comfort (including unsociable behaviour) of other clients, him or herself or the environment. In such circumstances TTNZ will not be obliged to offer any refund or transfer of tour.

To the extent permitted by law, all our liability for damage to your property, disruption to travel plans, or mental injury is excluded. This is subject to any rights you may have under the Consumer Guarantee Act 1993 if booking in NZ. If sections of the Act do apply TTNZ NZ Ltds’ liability is limited to resupplying the services or paying the costs of resupplying the services, whichever is the lesser.

WARNING: Under New Zealand law it is extremely unlikely that you will be able to sue anyone if you are injured and/or suffer disruption in your travel arrangements. TTNZ holds a current public liability insurance policy covering all tours advertised by TTNZ.
